Terms of Service

 

Agreement to terms


Any use of this website Discussion Forum shall be in accordance with these Terms (Terms), the Privacy Policy and the website Terms and Conditions of Use. In using this Discussion Forum and other Wheelock Angling Society (WAS (the administrative team, its committee members and the society in general) internet based services, including the website, you agree to be bound by these terms here listed. WAS reserves the right to make changes to these Terms from time to time without notice and it is your responsibility to determine such changes. Continued use of the Discussion Forum shall be deemed acceptance of any changes to these Terms.


1. Access to the Discussion Forum

In consideration of your use of the Discussion Forum, you agree to:

·       provide true, accurate, current and complete information about yourself as prompted by the Discussion Forum registration form; and

·       If the administrators of the discussion forum have reasonable grounds to suspect that any information is untrue, inaccurate not current or complete, we have the right to suspend or terminate your registration

·       You must give your proper name (i.e. 1st name and 2nd name or 1st initial and 2nd name only) and your membership number on application as requested by the registration process. ‘Handles’, nicknames or alternative methods of login will not be permitted on the WAS private discussion forum, use of such alternative naming will result in no access to the forum. Use of false names will result in termination of forum membership. Use of another’s account will result in sanction application, see Section 4.

·       The W.A.S administration team will permit the use of ‘avatars’ (images by your name), however, it is important that you use pictures of yourself fishing or acceptable (by the administration team) scenery shots (taken whilst fishing or otherwise)  - these are the only permitted avatars on the W.A.S. forum. *NO* images of other people are to be used, either fictional or real. Unacceptable images will be removed from the forum and the posters rights to a: use avatars and b: post any imagery will be revoked. Your attention is drawn to Section 3, ‘Content posted to the Discussion Forum’. For the quality of the forum, the WAS forum administration team’s decision is final in all matters.

2. Privacy Policy
Details provided by you and certain other information about you is subject to our Privacy Policy.

3. Content posted to the Discussion Forum
You understand that all data, text, messages or other materials ('content') that are publicly posted or privately transmitted are the sole responsibility of the person from which the content originated. This means that you is solely responsible for all content that you upload, post or email via the Discussion Forum. The views posted by others do not necessarily reflect the opinion of WAS. We do not control the content posted via the Discussion Forum but will moderate that which is deemed unacceptable under the terms of our Acceptable Use Policy (AUP) and therefore do not guarantee the accuracy, integrity or quality of the content.

Under no circumstances will WAS  be liable in any way for content, including (without limitation) any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of your use of any content. You agree that you must evaluate and bear all risks associated with the use of any content including reliance on its accuracy or completeness. You also understand that by using our Discussion Forum and our site, you may be exposed to content that is offensive, indecent or objectionable. WAS administrators will seek to remove such offensive content (their sole decision) as soon as it practicable but there may be times when you are exposed to such content. WAS will accept no responsibility for this.

 


You agree that you will not use the Discussion Forum or any part of our site to:

Without prejudice we reserve the right to block or remove any material that offends these principles.

4. Right to erase messages and suspend access / sanctions
As soon as we are made aware of activities that breach these Terms, our Terms and Conditions or our Privacy Policy, prompt action will be taken. If you witness such breaches in the Discussion Forum or anywhere else on the WAS site, please notify cbailey@sysol.demon.co.uk immediately.

On being made aware of such breaches, WAS may ban, delete or prohibit any content that relates to those breaches or that we judge harmful to individuals or to WAS itself, or any of our affiliates, licensors or partners;

We reserve the right to take whatever action we deem necessary to prevent such breaches including the following:

All incidents will be logged and our (the WAS administration team) decision is final in all cases.

Any breaches may lead to us reporting your activities to your internet service provider, your employer, relevant authorities, or to legal action being taken against you, or both.

In addition we may at any time move, modify or remove any content or take further legal action as a result of breaches or suspected breaches of these Terms, our privacy policy any applicable laws or regulations or where our rights or third party rights are threatened or infringed.

5. Indemnity
You agree to indemnify and hold WAS, and its subsidiaries, affiliates, committee member, agents or partners harmless from and against any direct or indirect loss or damage (including consequential loss and loss of profits, goodwill or business opportunities including reasonable legal costs arising from any third party claim in relation to any content you upload, post or email through the Discussion Forum or the site, your use of the Discussion Forum and our site, or your breach of the provisions of these Terms. This indemnity may be enforced by an Indemnified Party in his own right and the Contract (Rights of Third Parties) 1999 shall apply.

6. General practice regarding use and storage
You acknowledge that WAS may establish general practices and limits concerning use of the Discussion Forum service, including without limitation the maximum number of days that postings or other uploaded content will be retained or archived within this Discussion Forum, the maximum size of any email message that may be sent from or received by an individual on the Discussion Forum and the maximum disk space that will be allotted on the WAS's servers on your behalf.

7. Suspension or modification of the Discussion Forum
We reserve the right at any time and from time to time to modify, suspend or discontinue the Discussion Forum (or any part thereof) with or without notice.

8. General protection
WAS accepts no liability or responsibility whatsoever for any loss, disruption or damage to your data or your computer system whilst linked to this forum or the WAS website.

9. Loss of information

WAS accepts no responsibility for any information you may lose as a result of data failure on the WAS forum. Whilst WAS will take all efforts to effect a prudent back regime, errors can and do happen. WAS will accept no responsibility for actual or consequential loss resulting in loss of such information. Simply, if you feel that data on the forum is essential to you or something that you do, then it is your responsibility to ensure that this data is securely backed up. This includes emails, ‘PMs’, images, sounds, addresses, phone numbers and any other information that may be stored in any way within a forum in an electronic form.

For the quality of the forum, the WAS forum administration team’s decision is final in all matters.
